OTT 서비스 규제기준에 관한 연구 - 내용적 규제를 중심으로 -

While recently viewing of audiovisual contents not by traditional television but by new devices, for example, personal computer(PC), tablet PC or smart phone, etc. is increasing and diverse providers of audiovisual content service are appearing, the issues of regulation on the so-called ‘OTT(Over the Top) service’ is caught up in controversy. Especially, the one of the issues is whether to regulate OTT service according to broadcasting regulation standard or Internet regulation standard in content regulation. This study aims to suggest the regulation standard of OTT service in content regulation. For this purpose, this study defined OTT service as “audiovisual content service over the Internet regardless of kinds of device”. Regarding the content regulation standard of OTT service, assertions of this study are as follows. First, OTT service doesn't come under the concept 'broadcasting' of the current Broadcasting Act according to legal interpretation. Second, in a viewpoint of the structural character of the Internet and legitimacy of regulation, the regulation standard and level of OTT service based on the Internet should be relaxed rather than broadcasting. Third, in a viewpoint of audiovisual content service and effectiveness of regulation, audiovisual contents by OTT service can be regulated fully by the current regulation systems. Fourth, solving of regulation asymmetry problem in OTT service should be done carefully in content regulation while considering need and direction of solving of regulation asymmetry problemFifth, OTT service is non real-time service based on space-editing rather than real-time service based on time-editing. And non real-time service enhances user's power to choose information more than real-time service. Therefore a theory that OTT service should be regulated according to broadcasting regulation standard is not appropriate.
