인프라스트럭처 조달 영역에서 보조금 지급의 법적 문제와 쟁점들 - 유럽연합의 보조금 규율정책을 중심으로 -

초록

Because the procurement of infrastructures is by far associated with states policies and other industries, conflicts about states aids are apt to occur. In European law the state aid lies on the borderline between prohibition and permission. Therefore a study about it is very meaningful. In awarding procurements it is to judge whether a grant of aids corresponds certain undertakings or the production of certain goods and distorts competition. A valid notice about aids is also important. In addition that is a case, if the construction of infrastructure or awarding a concession-procurement represents an aid itself. Lastly the procurement by a public enterprise or a mixed public-private company must also be considered. Currently the interdependence in global economy is intensified. The European law regulates a single market which is composed by member states of EU. From the European law we can find a political method which can maintain the balance between a competition and a promotion of infrastructures.
