사법권 독립의 의미와 한계: 사법권 독립과 책임의 조화에 대한 이론적 탐색
초록
This study explores the constitutional meaning and limits of judicial independence in response to the dramatic expansion of judicial power within contemporary democratic systems, seeking a theoretical harmony between judicial independence and judicial accountability. Traditionally, judicial independence focused on securing an equal status with elected branches to protect citizens’ liberties from the “tyranny of the majority” in legislative and executive spheres. However, as the “judicialization of politics” has elevated the judiciary into a formidable power that renders final decisions on major social issues, there is a growing discourse that judicial independence should be viewed as a functional instrument for achieving fair trials and the rule of law and democracy rather than an absolute, sacrosanct dogma. In this context, while independence from case litigants remains an absolute requirement, independence from other democratic branches and the public must be understood as a flexible concept that accommodates a legitimate and reasonable degree of involvement and restriction. To ensure judicial independence does not devolve into mere rhetoric or a rigid dogma, it must be recognized as existing for the benefit of the judicial system, the government, and the people, allowing its level to be adjusted accordingly. Judicial accountability is presented as a counterbalancing value in determining the content and level of independence; however, since both values ultimately serve the goals of democracy and the rule of law, they must be implemented harmoniously. Ultimately, to secure its independence, the judiciary must earn public trust by conducting fair and neutral trials. The judiciary must provide predictability and legal stability by maintaining consistent precedents supported by transparent and compelling logic. Furthermore, the courts must demonstrate democratic accountability through fair procedures, thorough hearings, and comprehensive reasoning that reflects various arguments. The true realization of judicial independence lies in the judiciary functioning as a core power of democracy—securing public support through expertise, morality, and fairness, while engaging in continuous interaction with elected powers to establish institutional trust.
