의료면허제도의 기원과 목적

초록

The medical license system is a representative system in which the state regulates the qualifications of medical professionals, considering that medical practice can cause risks along with the recovery and promotion of health by the direct influence on human life and the body. Historically, there are two reasons in which the state has regulated the medical licenses. The first is the demand for the exclusive authority of the medical professional groups. The second is that the state introduced the medical licensing system as a means of controlling the medical professional groups from the perspective of protecting the health and life of the people, one of the major policies of the state. Both of these reasons for the introduction of the medical license system are recognized in both East and West, but I think there is a difference in its emphasis. In the West, the aspect of strengthening the autonomy and authority of the medical professional groups is the main reason for the national regulation of the medical licenses, while in the East, especially in Korea, the national regulation of the medical licenses was introduced according to the needs of the state. The the discipline of the medical groups by the state is still acting as an main element of Korea's medical policy, as can be seen from the numerous revisions of the Medical Service Act. I think that the recent dispute between the medical groups about the specific medical practices has exposed the problems in the process of introducing the medical license system in Korea. I think it is very important to examine why the medical license system was introduced and how the national rules for medical licenses have changed in the course of the transition of the Korean Medical Service Act. With such awareness in mind, this paper attempted to examine the changes in the medical license system in the West and Korea and the changes in Korea's medical license system through the enactment and amendment of the Medical Service Act.
