대의민주주의를 넘어, 하이브리드 민주주의는 가능한가? ― 새로운 민주적 거버넌스 모델을 위한 시론 ―

초록

This paper tries to examine ideas beyond “passive” and “constitutional interpretation theory,” which confines the meaning of representative democratic system to elections and free mandate under the 1987 Korean Constitution. Furthermore, it deals with redesigning of the structure of the governance of the Republic of Korea, turning it into “proactive” and “constitutional policy theory” that combines new layers from constitutional amendment and legislation. To this end, it identifies the origin of the current crisis in our constitutional government as the winner-take-all way of Cheong Wa Dae government. It also highlights that direct democracy and deliberative democratic elements have been actively discussed in the interpretation of representative democracy in our Constitution since the 1987 revision and also in the constitutional amendment on democratic governance, which emerged in post candlelight vigils and impeachment in 2016-17. Finally, as a governance model that embraces the crisis of representative democracy and the following changes required, it explores the possibility of “hybrid democracy” with an integrated theory that defines democracy based on two concepts, participation and deliberation. It institutionalizes the process of optimizing participation and deliberation according to the circumstances.
