리걸 클리닉 교육의 발전방안에 관한 소고

Clinical Legal Education was the newest and most challenging of the legal education tasks attempted at Korea's law school. It allows students to go beyond practical legal education and experience community service through law. Law students have the opportunity to develop ethical lawyers. This is very attractive in terms of legal ethics education and is consistent with the intent of Article 1 of the rule on law school. However, clinical Legal Education, like many projects of legal education tried at law schools, has been trial and error in many respects. Over the past decade, legal and institutional challenges about legal clinic have been drift unsolved before the immediate homework of the bar exam. What are the desirable aspects of clinical legal education in Korea? This study proposes development plans for revitalizing clinical legal education to solve the reality of lawmaker education. First, I review the process and problems of 10 years of Korean clinical legal education (Ⅱ. Clinical Legal Education of 10 Years and Challenges). I explain the problems in terms of the educational gap between law schools. Then, I suggest the ways to develop clinical legal education through cooperation between law schools(Ⅲ). Lastly, I propose the implementation of the Criminal Defense Legal Clinic through the enactment of the Practice Rule of court for law students(Ⅳ). I look forward to future clinical legal education as the center of law education and to become a turning point of Korean law education.
