2012 세계자연보전총회 발의안 개발 및 채택을 위한 연구: 자연재해로 인한 제2차 환경 피해 관리

초록

Recently, we have experienced increasing numbers and severity of natural disasters. Natural disasters cause not only damages to human life and health but also damages to the environment. Especially, so called the secondary damages to natural environment through industrial accidents after natural disaster is getting importance in these industrial societies. Fukushima nuclear accidents of 2011 can be illustrated as one of examples of the secondary environmental damages. Fukushima accidents has left the legal problems of international and national legal system regarding the management of the secondary environmental damages. First of all, national legal system regarding the management of the natural disaster focuses to protect human life and health and property damages It is necessary to protect environment itself including restoration of it and monitoring system for the restoration. Moreover, this process should be done in the cooperation with environmental authority. The international legal system regarding the management of the natural disaster which has been developed since the Chernobyl accident is the early notification system. The early notification system asks origin countries of the disaster of notifying the detailed information regarding the disaster including its preventive measures to neighboring countries who might be affected by the disaster. However, the system showed some defects such as unclear scope of the information to be notified and subject countries who can be entitled to be notified. The information regarding the discharging of the radioactive water into the sea of Japanese government was not notified to neighboring countries including Korea and China. It was discussed in the TEMM(Tripartite Environment Ministers Meeting) and Summit of Korea, China and Japan in 2011 and they agreed on the subsequent measures regarding the natural disaster management. This study was projected and developed in order to raised the importance of the management of the secondary environmental damages in the World Conservation Congress which is a general assembly of IUCN(International Union for the Conservation Nature and Natural Resources). It explore the contents of the motion and its process including subsequent tasks for the motion.
