메타버스 환경에서 발생한 국제 저작권 분쟁과 그 해결 방안에 대한 연구

초록

Along with the huge interest in the metaverse today, concerns over how to resolve various legal issues arising from the metaverse environment are growing. Since many copyright-related disputes are expected to arise in the metaverse, it is necessary to reconsider how to resolve various international copyright disputes occurring in the online environment, especially in the context of the metaverse. Application of principles proposed by scholars regarding intellectual property right and private international law to the metaverse shows the following: 1) the courts of each country may exercise special international jurisdiction at least over copyright infringement or lawful use of copyrighted works that occurred in that country and other matters relating to copyright in that country, which brings dissatisfaction to both the plaintiff and the defendant; 2) anyone who engages in activities involving copyright in the metaverse can be subject not only to its national copyright law but also foreign copyright laws. As such, this paper presents possible solutions to international copyright disputes arising from the metaverse environment and analyzes the practicalities, strengths and weaknesses of each solution.
