Ethical Guidelines for Reporting on Vulnerable Groups — A Practical Application of Constitutional and International Human Rights Norms —

This study aims to assess whether the codes of ethics and guidelines for media coverage for the protection of socially vulnerable groups are operating effectively and effectively, and to propose practical measures for improvement. To this end, drawing on the principles of human dignity, equality, and non-discrimination emphasized in the Constitution and international human rights norms, as well as prior research, the categories of socially vulnerable groups were specified as children and adolescents, persons with disabilities, the elderly, immigrants and foreigners, North Korean defectors and residents, sexual minorities, economically vulnerable and the poor, and gender equality reporting. The study subjects included codes of ethics and guidelines from major domestic broadcasters (KBS, MBC, YTN, TV Chosun, JTBC), newspapers (Chosun Ilbo, Hankyoreh), media-related associations and organizations (Journalists Association of Korea, National Human Rights Commission, Press Arbitration Commission), and international media ethics organizations (SPJ in the US, IPSO in the UK). The study analyzed their formal and substantive characteristics and the presence of guidelines for each category of socially vulnerable groups. The analysis revealed limitations in that most codes of ethics remain mere declarative principles without specific case studies. While many codes of ethics for children and adolescents provide relatively specific and actionable guidelines, few codes of ethics explicitly specify specific provisions for categories with relatively high levels of controversy or low social awareness, such as economically vulnerable groups, sexual minorities, and immigrants. This trend is particularly pronounced in the absence of codes of ethics that explicitly stipulate protections for economically vulnerable groups. This is not simply a practical deficiency within the media industry; it also carries significant limitations in that it fails to adequately reflect the categories of socially vulnerable groups required by the Constitution and international human rights norms. Based on this analysis, we propose the following recommendations for establishing actionable ethical standards that go beyond declarative ones. First, individual provisions directly addressing socially vulnerable groups are needed, in addition to anti-discrimination provisions. Second, a concrete code of ethics is urgently needed, particularly to protect the economically vulnerable and the poor. Third, guidelines should be expanded to include concrete examples so that media professionals can directly refer to the practical standards. Fourth, provisions related to socially vulnerable groups need to be defined in a more detailed and specific manner. Fifth, for ethical codes and guidelines related to socially vulnerable groups to be effectively implemented in the field, measures to strengthen the practical foundation must be implemented in parallel. To this end, we propose a media ethics training program specifically designed to protect socially vulnerable groups. Furthermore, building a “Toolbox for Journalists” based on the Society of Journalists (SPJ) Tool Box could be one solution. Finally, continuous and organic collaboration between relevant academic communities and the media industry is necessary to improve the code of ethics.
