Study on the Regulation on Illegal Internet Distribution of Copyrighted Works

초록

Popular Internet software based on a peer-to-peer architecture has been used to share copyrighted movies, music, software, and other materials. Concerned about the consequences of illegal copying and distribution on a massive scale, content owners are interested in technical protection measures (TPM), which includes measures that control 'access' effectively provides copyright owner with rights which significantly broader than currently provided by the international copyright treaties. Unfortunately, the technical challenges for securing digital copyrighted works are formidable and previous approaches have not succeeded. This study overviews the concepts and approaches for TPM. This article has also focused on four important constellations of regulation on illegal internet distribution of copyrighted works. In particular, Korea's government has become the latest country to pass a so-called three strikes law to crack down on online copyright piracy. This study aims to offer a better understanding of the legal issues related to current copyright law amendment to regulate illegal internet distribution of copyrighted works.
