소년사건 심판 및 집행상의 문제점 및 개선방안

초록

The purpose of the juvenile justice system in Korea is to correct the juvenile delinquents. To reach this purpose the Korean Juvenile Law has adopted the principle of parens patrie. But there are many challenges to the thesis that the juvenile court must be a kangaroo court, especially since the late of 1960's. One of the challenges is that the due process of law must be emphasized in the juvenile justice as same as in the adult court. In this article are studied to the ways to harmonize these two request(the principle of pxirens patrie and the due process of law) in the juvenile justice system in Korea.
