한-EU FTA에서의 지리적 표시 보호제도 개선에 대한 연구
초록
On 1 July 2011, the Korea-EU Free Trade Agreement (Kor-EU FTA) entered into force. Building on WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement) Agreement, the Kor-EU FTA provides for the protection of individual geographical indications (GIs) for agricultural products and foodstuffs listed in its Annex 10-A comparable to the level of the additional protection stipulated in the TRIPS Agreement. The list may be extended to other products in future if the EU and Korea agree. However, Such TRIPS-plus approach gives more benefits to the EU side and pose implementation challenges to the Korean side including the extension of the original list of GIs. The purpose of this paper is to survey provisions concerning GIs in the Kor-EU FTA and to highlight how these provisions compare with GIs provisions under the Japan-EU Economic Partnership Agreement and the multilateral trading system as embodied in the TRIPS Agreement. Furthermore the paper focuses on some specific issues about the extension of the original list of GIs and renegotiation strategies for the implementation/improvenment of the Kor-EU FTA.
