글로벌 시대의 행정소송의 전망과 과제

초록

Modern administrative litigation system is under the confrontational structure between the freedom and rights of individuals and govermental powers. The administrative litigation system in the era of globalization must be the Public Forum, in which the important social problems could be discussed and determineded beyond the relief function. It can supplement the limits of democracy. To perform these roles the type of administrative litigation should be added to. Compared to the civil action the role of administrative litigation should be expanded. Therefore the scope and range of administrative action and standing also should be expanded. It is necessary that the judicial review system must be the Public Forum, in which the public interest and the rights and interests of the individuals harmonizes.
