통합물관리를 위한 대응방안 ― 수리권법의 제정 ―

초록

Enactment of the Framework Act on Water Management provided the good basis of the integrated water resources management(IWRM). IWRM changeovers the approach from development of water resources, isolation of water quality and quantity, conflicts between upstream and downstream, and focus on use and control of water resources, to efficient and balanced waste management, substantial integration of water quality and quantity, watershed management based on participation and cooperation, and environmentally-friend river management. It is easy to leave out the fact that the unification of water right has an important meaning for IWRM. That is because the streamlining of water right is directly related to the equitable and reasonable utilization of water. Under the existing law, regulations on water right are overly simple, vague and duplicate. The uncertainty surrounding the characteristics, contents, range, and effects of water right are the very causes of disputes related to water. The unification of water right is necessary in order to prevent such disputes and attain efficient and systematic management of water right. This should involve the abolition of water right-related regulations that are scattered over separate laws and the integration of those regulations into one law. This paper roughly suggests the potential contents of so called Water Right Act in the form of a draft bill. The fact that this proposal only draws a general outline mainly comes from the lack of discussions related to the matter during the past. The reason why discussions related to water right failed to crystallize into a single, integrated bill partly has to do with doubt cast on whether the IWRM will actually work, and egoism among different departments. The delegation of all the work related to water management to the Ministry of Environment(MOE) is enough to reverse the atmosphere. The IWRM is essential to ending the dispute that had lasted for the past 20 years and attaining sustainabe development in the water management field. In this respect, we must start to seriously consider the integration of water right. The government and political sphere must be determined. We must have the courage to endure some disadvantages the integration process that may entail.
