의사의 의료행위와 한의사의 한방의료행위의 범위와 한계

초록

Medicine and Oriental medicine have been developed from different bases and there gas been hot debate to distinguish medicine and oriental medicine. The distinction between two is very important in practice. If a doctor practices oriental medicine or an oriental doctor practices medicine, he/she shall be punished because he/she practices without license. Sometimes medical society and oriental medical society struggle whether a particular practice is medical practice or oriental medical practice. I think the elements of legitimacy of medical practice are (1) the subject should be a medical doctor, (2) the purpose of medical practice is to enhance human health and to protect human life, (3) the practice should be done according to medical standard, (4) the practice can be acceptable to the society. Also, the elements of legitimacy of oriental medicine are (1) the subject should be an oriental medical doctor, (2) the purpose of medical practice is to enhance human health and to protect human life, (3) the practice should be done according to oriental medical standard, (4) the practice can be acceptable to the society. Medical license or oriental medical license is protected by government. The person who has a medical license or oriental medical license can practice medicine or oriental medicine. Even if a person has good skill to practice medicine or oriental medicine, or has learned several hours in private sectors, he/she can not practice medicine or oriental medicine legitimately without medical license or oriental medical license. Respect can not be obtained by force or pressure. The specialists can be respected because he/she has proper and enough knowledge in that field and good skill. Also the specialists should have pride on his/her field.
