Public Interest and Technology Transfer Models

초록

The COVID-19 pandemic in the whole world creates new risks. Considering that the purpose of drug development is to cure disease and keep healthy, the ultimate goal of this study is to review the international norms on pharmaceuticals to enhance the access to patents related to COVID-19 treatments and vaccines. The protection of drug patents are on the one hand beneficial to the development of new drugs, but on the other restricts the access of low income brackets to drugs by allowing the monopolized patent owner to set high prices on drugs. There is the need to go beyond the current controversy on patent protection and innovation and find methods for the flexibility of the protection of IPRs from the perspective of human rights. For the advancement of medicine access and the reform of the compulsory license system, this study will analyze the main issues of the TRIPS Agreement and negotiations on its revision, and propose methods for the advancement of drug access and the systematic reform for strengthening competitiveness of new medicines. In this paper I intend to review the possible solutions for technology development and transfer for the improvement of access to medicines. Furthermore, I suggest that the creation of an patents pool, patent commons and Open Covid license model would help to ensure access to key technologies.
