SFFA v. Harvard and the Future of Race-Conscious Admissions

초록

In case ‘SFFA v. Harvard’ proves Asian discrimination in Harvard University admissions, the beneficiary of Asian discrimination is likely to be white instead of black or other minorities. And the issue of Asian discrimination raised by this lawsuit by SFFA is not always correlated with abolishing affirmative action. If ‘SFFA v. Harvard’ can uncover hidden white privilege and facilitate the holistic review process of Harvard more transparently, and further reduce and abolish legacy admission, which symbolizes “affirmative action for whites”, this lawsuit will contribute to realizing racial justice. Therefore, it would be meaningful to see how the lawsuit proceeds, paying special attention to whether or not it creates voice for the benefit of Asian without criticizing or discriminating against black, Hispanic, or even other Asians.
