일본 방송심의제도의 자율성에 대한 비판적 고찰

초록

The major purpose of this paper is to examine the contents regulation system of the Japanese broadcasting media and reveal problems of the so-called ‘self-regulation’of the media. In fact, review on the content of the media, although it is not prior-restraint, is likely to put some chilling effects on the media. For this reason, self-regulation has been recommended as the best answer. Japan is one of the exemplary countries that carry out self-regulation on broadcasting contents. After World War II, Japanese society has considered “freedom of expression and the press”as the foremost important right of the Japanese people and gradually removed the possibility of the government intervention over media regulation. There have been some research reports on self-regulation system of the Japanese broadcasting media. However, few have exactly pinpointed the problems or issues of the self-regulation system of the Japanese broadcasting media based on empirical data or interview with those who actually participate in review process. To achieve the goal, authors interviewed some people who are in charge of review on the contents. It was found out that Japanese review system now had some critical problems which rose from the failure of Cartel system of the media, which conventionally gave power the broadcasting market to voluntarily adhere to self-regulations on the contents.
