스마트 시대의 콘텐츠 규제의 동향과 문제점 ― 청소년 보호를 위한 인터넷 및 게임 규제를 중심으로 ―

초록

This study aims to analyze the problems of current content regulations for youth protection, and to present systematic improvement plans. To do this, first of all this study suggests six principles or factors which should be considered in content regulation for youth protection. The six principles or factors are as follows. First, due to the difference between illegal content and harmful content, regulation of illegal content and regulation of harmful content should be separated thoroughly. Second, to allow adult to access to harmful content while to block youth to access to it, discriminative access control between adult and youth should be arranged. Third, paternalism of the state should premise the deference to family autonomy and parents' right to educate their children. Fourth, content regulation for youth protection should be designed supposing harmony with current government's public rating system. Fifth, in regulating harmful content for youth protection, harmony by balancing between the public interest of youth protection and the limited rights of youth and adult is needed. Sixth, self-regulation is needed to be enhanced in designing the system about youth protection. With above six principles or factors, this study analyzed the problems of youth age verification and authentication system, the regulation of advertisement on media materials harmful to youth, Internet game shutdown system, regulation of child pornography, the system of person responsible for protection of youth.
