고용친화적 복지증진을 위한 단체모델에 관한 연구- 법정책적 방안을 중심으로 -

초록

One of the problems facing our society today is how to be fulfilled the demand of welfare for the people in ‘jobless growth'. It could be the most realistic and preferred solution for this welfare problem to provide welfare by creating employment-friendly economic environment rather than simply to supply economic benefits. In reality, however, it is another matter who will solve the problem of the high-order equation: ‘employment-friendly welfare’. In this respect, the author supposed that organizations such as NPO might have the key to solve this problem and he explored various types of organizations existing in our society. In this regard, current legal regulations about a variety of organizations and the characteristics of the organizational models were compared in the various aspects. As a result of examination, the author evaluated that there are many restrictions for organizations to pursue a social purpose as ‘employment-friendly welfare’ in current legal situation of our country. Whereupon the author proposed legal political improvements needed in order that organizations recognized in current law can be utilized properly to promote employment-friendly welfare. First, various alternative organizational models should be taken advantage of by getting out of Corporation-centered organizational model. Second, organizational model of cooperative should be established in the basic law for cooperative. Third, the concept and status of social enterprise should be redefined. Fourth, legal partition between for-profit and non-profit legal entities needs to be lowered. Fifth, in order that public entities and public trust can be utilized more actively, the relevant laws should be revised. Sixth, the author suggested some legislative improvements to make possible for establishing new form of organizations.
