사회복지수급권의 쟁점 연구

초록

The realization and contents of social welfare rights appear to be different depending on the development of the country, political, social, cultural and economic maturity. Historically speaking, social welfare rights reflects the process that welfare consumers need and win about their right to social welfare and and the consumer's desires(needs) are newly created or will be changed in accordance with the a change in the trend of the times and the society. New trends and states of social welfare rights in Korea are as following. Change of welfare needs due to low birth rate and aging society, privatization and marketization of social welfare delivery system due to the neo-liberalism, the workfare(productive welfare), the welfare methods using smart information communications technology this so-called ‘smart welfare’, selection of litigation types in social welfare lawsuit. These are discussed mainly in this paper. In this study, the theoretical issues of the two types of proceedings in the suit that are Appeal Litigation Parties Litigation, and problem of the impact of neo-liberalism (privatization, marketization, productive welfare) to social welfare rights were dealt with.
