노사의 제도와 규제 작성자로의 역할 전환에 관한 역사적 고찰:사회협약의 입법과정을 중심으로

초록

Based on the analysis framework of strategic choice and social learning, the study analyzed the social pact and legislative process in 1998 and found that the roles of management and unions were transformed into authors of systems and regulations as the social pact legislative system was formed. This paper studied the legislative process of the 15th National Assembly’s Environmental and Labor Committee in connection with discussions on social pacts based on case analysis by process tracking method. The action of strategic choice was confirmed in that the labor union, employers’association, and the government and political parties commonly decided on social concertation and cooperative legislation instead of policy-making unilateralism. This study has theoretical significance in that it proved the usefulness of the analysis framework of social learning and strategic choices that explained the formation of a legislative system for social pacts without prerequisites for neo-corporatism in Korea.
