지리적 표시의 등록거절사유와 품질관리에 관한 고찰 -일본의 ‘핫초미소(八丁味噌) 사건’을 중심으로-

초록

This study examines the legal criteria and quality management challenges in the registration of Geographical Indications (GI) by analyzing ‘Hatcho Miso’ case in Japan. The ‘Hatcho Miso’ case is arose when a traditional miso producer, excluded from the designated producer group, faced restrictions on using the “Hatcho Miso” designation despite centuries of continuous use. This case highlights the need to reassess the coherence and effectiveness of the GI system, particularly regarding the legal protection of regional traditions and product quality. The study examines the substantive grounds for refusal and the comments provided by the competent authority. Furthermore, by comparing Korean case, the paper identifies the necessity of post-registration quality control and proposes legal improvements to the GI system.
