프랑스 변호사의 직무윤리 및 징계제도와 그 시사점

초록

Lawyer's mission is to protect basic human rights and realize social justice. Lawyers must faithfully perform their duties and strive to maintain social order and improve the legal system. It is the primary appearance for attorneys to pursue public benefits in relation to serve the public. Therefore, lawyers must establish and practice strict professional ethics. Nevertheless, cases of violation of professional ethics by lawyers are increasing. There is a great need for study on lawyers' professional ethics and disciplinary system. In France, morality is required as a qualification for lawyers. French lawyers must observe the principles of honor, trust(loyalty), equality, non-discrimination, fairness, friendship, delicacy, moderation, courtesy(politeness) in performing their duties and demonstrate competence, dedication, sincerity and prudence to the client. In addition, France guarantees the autonomy of bar associations in disciplining lawyers. Its Implications for Korea are reinforcement of lawyer qualifications, professional ethics, discipline, and securing independence and autonomy of the Bar Association for disciplinary procedures
