Some proposals for establishing workers’ universal rights

초록

This paper is recommendations for reforming labor policies in a new Government beginning from June 4. of 2025. New labor policies should be based on the fundamental values of the Constitution of Republic of Korea such as a democratic republic, equal protection before the law or rule of law. New labor policies also have to be coped actively with the changing circumstances of world of work; development of technology by digital transition, continuing climate crisis causing by climate change, demographic aging and changes in social values. In order to establish workers’ universal rights, laws concerning employment and labor relations should be laws of the all, for the all, by the all. Labor laws of the all require that they have to be applied to all working people. Accordingly the Labor Standard Act should be applied to workshops using 4 workers or less; new act should be made for the economically dependent workers; unified labor code will be prepared for enhancing legal accessibility of all working people. Labor laws for the all require that they have to be useful to both the present workers and the future workers. For the purpose of this, some policies are necessary introduction of rest-led working time system, extension of retirement age and increasing protections for immigrant workers. Labor laws by the all require work rule based on the consent of both workers and a employer and industrial collective bargaining and agreement.
